Welcome to GeneralResourceClearing ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your access to and use of our yacht charter services and the website available at generalresourceclearing.sbs (the "Service") managed by GeneralResourceClearing.

By reserving a yacht or using our Services, you consent to abide by these Terms. Should you not agree with any part of the terms, then you are not permitted to use the Service.

2. Service Overview

GeneralResourceClearing offers high-end yacht charter services, which include but are not limited to:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

All services are subject to availability and favorable weather conditions. We retain the authority to alter or cease services without prior notification.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you should:

  • Be of a minimum age of 18 years
  • Submit precise and complete details
  • Remit the necessary initial payment as detailed in your reservation affirmation
  • Concur with these Terms & Conditions

3.2 Confirmation

Your reservation is deemed firm only after we have received the payment and issued our written confirmation. We reserve the discretion to reject service to any person.

3.3 Availability

All charters are subject to the availability of the vessel and suitable weather conditions. We will strive to fulfill your chosen dates and times.

4. Payment Terms

4.1 Pricing

Prices are quoted in € and include all applicable taxes unless stated otherwise. Prices may be changed with no prior notice.

4.2 Payment Schedule

  • Deposit: 50% of the total charge for the charter is due upon reservation
  • Final Payment: Owing 48 hours prior to the departure of your charter
  • Other Fees (if applicable): Payable at the end of the charter

4.3 Payment Methods

We accept major debit and credit cards, electronic bank transfers, and certified cheques. Our payment procedures are conducted through safely encrypted platforms.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • With more than 72 hours before departure: Entire payment returned less processing charges
  • Between 24-72 hours before departure: Half of the payment refunded
  • Less than 24 hours before departure: No reimbursement

5.2 Weather Cancellations

In circumstances where the weather is determined as unsafe by our captain, we will suggest to:

  • Reschedule your charter to another available day without any additional cost
  • Issue a complete refund if rescheduling isn't an option

5.3 Mechanical Issues

If your allocated vessel encounters mechanical issues, we will make efforts to provide a reasonable alternative. In the absence of an alternative, a full refund will be granted.

6. Safety and Conduct

6.1 Safety Requirements

All guests should:

  • Adhere to all directions given by the crew
  • Utilize the safety equipment when deemed necessary
  • Inform about any medical conditions which may impact their safety
  • Stay within the proper areas of the vessel

6.2 Prohibited Items

Certain items are disallowed on board, including:

  • Glass containers
  • Illegal substances
  • Firearms or other weapons
  • Excessive non-alcoholic drinks (beyond reasonable consumption)
  • Pets (unless prior authorization has been granted)

6.3 Conduct

Passengers are expected to behave in a considerate and respectful manner. We have the right to halt a charter prematurely without issuing a refund if the behavior of any passenger endangers safety or hinders the experience of others.

7. Liability and Insurance

7.1 Our Liability

Our liability is restricted to the cost paid for your charter. We are not accountable for:

  • Personal injuries arising from guest negligence
  • Loss or destruction of personal belongings
  • Indirect, incidental, or punitive loss or damages
  • Delays due to weather or situations outside of our control

7.2 Insurance Coverage

We carry comprehensive insurance for our vessels and operations. It is the responsibility of passengers to secure their own travel and personal effects insurance.

7.3 Assumption of Risk

You acknowledge that engaging in marine activities has innate risks and you accept the responsibility for your personal safety and health.

8. Modifications and Itinerary Changes

We retain the right to adjust itineraries, pathways, or timetables because of weather elements, safety concerns, or operational necessities. We shall endeavor to provide equivalent alternatives where necessary.

9. Force Majeure

We bear no responsibility for delays, cancellations, or changes caused by forces beyond our control, including but not limited to:

  • Severe weather situations
  • Natural disasters
  • Governmental decrees
  • Port shutdowns
  • Mechanical breakdowns

10. Privacy and Data Protection

Your personal information is processed in alignment with our Privacy Policy. By availing our services, you consent to the collection and usage of your data as outlined in our Privacy Policy.

11. Intellectual Property

The content on our site, including texts, images, graphics, and trademarks, is safeguarded by copyright and trademark legislations. Any unauthorized reproduction, distribution, or derivation of works is prohibited without our explicit consent.

12. Governing Law

These Terms are regulated by the laws in place in Germany. Any disputes will be resolved in the courts situated in Hamburg, Germany.
